RECORD OF PROCEEDINGS

AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS

IN THE MATTER OF: DOCKET NUMBER: BC-2011-02256

 COUNSEL: NONE

 HEARING DESIRED: NO

_________________________________________________________________

APPLICANT REQUESTS THAT:

He be granted an additional increase of 10 percent in retirement
pay due to extraordinary heroism in connection with the Bronze
Star Medal with Valor (BSM w/V).

_________________________________________________________________

APPLICANT CONTENDS THAT:

He was not aware of the 10 percent increase prior to his
retirement.

In support of his request, the applicant submits copies of award
and decoration citations.

The applicant's complete submission, with attachments, is at
Exhibit A.

_________________________________________________________________

STATEMENT OF FACTS:

The applicant was retired from active duty on 29 Feb 12 in the
grade of senior master sergeant having assumed that grade
effective and with a date of rank of 1 Aug 06.

AFI 36-3203, Service Retirements, paragraph 3.8.1, states since
extraordinary heroism is the criterion for award of the Medal of
Honor (MH), Air Force Cross (AFC), or equivalent Army or Navy
decorations, these awards provide automatic entitlement to the
additional 10 percent retirement pay (not to exceed 75 percent)
for enlisted members. Examiner’s Note: The BSM is not included
in these medals.

_________________________________________________________________

AIR FORCE EVALUATION:

HQ AFPC/DPSIDRA recommends denial. DPSIDRA states the BSM is
awarded for heroism, meritorious achievement, or meritorious
service; however, it is not awarded for extraordinary heroism.

The complete DPSIDRA evaluation is at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant
on 22 Jul 11, for review and comment within 30 days. As of this
date, this office has received no response (Exhibit D).

_________________________________________________________________

THE BOARD CONCLUDES THAT:

1. The applicant has exhausted all remedies provided by existing
law or regulations.

2. The application was timely filed.

3. Insufficient relevant evidence has been presented to
demonstrate the existence of error or injustice. The Bronze Star
Medal is not included among the group of medals that may entitle
a recipient to a 10 percent increase in retired pay. Therefore,
we agree with the opinion and recommendation of the Air Force
office of primary responsibility and adopt its rationale as the
basis for our conclusion that the applicant has not been the
victim of an error or injustice. Therefore, in the absence of
evidence to the contrary, we find no basis to recommend granting
the relief sought in this application.

_______________________________________________________________

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that
the application was denied without a personal appearance; and
that the application will only be reconsidered upon the
submission of newly discovered relevant evidence not considered
with this application.

MRBP states Air Force Instruction (AFI) 36- 3203 states deeds of "extraordinary heroism" may entitle an enlisted member to received 10 percent additional retired pay. Noting that the Air Force offices of primary responsibility are unable to make a determination based on the limited evidence provided and considering the fact that "extraordinary" determinations are somewhat subjective, we believe reasonable doubt exists in this case as to whether his actions were extraordinary.
